A judge took away the Colonia man's permit at a hearing he didn't even know was taking place
WOODBRIDGE -- An armored car driver whose permit to carry a gun while working was taken away by a judge without notice will have a chance to get his license back.
An armored car driver can re-apply for a permit to a carry a gun while working, an appellate court ruled. In a decision handed down earlier this month, a state appeals court reversed a ruling by a superior court judge that revoked the permit for Rickey R. Duncanson, of Woodbridge.
Duncanson's November 2014 application to carry a gun for his job as a driver and guard for the Garda armored car service was approved by the State Police.
In January 2015, a Middlesex County Superior Court judge conducted a hearing without telling Duncanson or State Police and denied the permit. Duncanson found out via a letter mailed to his Colonia home on Feb. 4.
The judge said the application had been altered to appear to give Duncanson the unlimited ability to carry a handgun.
The judge was not named in the decision, but open government activist John Paff submitted a records request that showed it was Judge Joseph L. Rea.
That judge's decision was reversed by the appeals court and Duncanson can now re-apply for a permit. His original permit allowed him to only carry a gun to and from work assignments.
