Carey said Sanchez allegedly opened fire on a group of men on Hale Street in New Brunswick on May 18, 2014 and struck Hernandez, who was not one of the intended targets.

Hernandez was taken to Robert Wood Johnson University Hospital in New Brunswick where he was pronounced dead at 1:08 a.m.

Two other men, who were sitting with Hernandez on the porch of the home on Hale Street, were wounded during the shooting, Carey said. One man was treated and released at the hospital. The other man suffered a wound to his finger and declined treatment.

The indictment was handed up following an investigation by Detective Drew Weiss of the New Brunswick Police Department and county Detective Gregory Morris with assistance from members of the Newark office of the U.S. department of Homeland Security.

Sanchez remains in custody in lieu of $1 million bail set when he was charged in December 2014. Bail was also set at $1 million for Herrera, who was arrested on Oct. 28, 2015 in Edison. Mendez is being held on $750,000 bail after he surrendered to police on Wednesday, Oct. 28, 2015.
