A Middlesex County grand jury is expected to take action Wednesday against the truck driver in the crash that injured Tracy Morgan.
NEW BRUNSWICK -- Kevin Roper, the truck driver in the accident that critically injured actor Tracy Morgan and killed another man, is facing action by a Middlesex County grand jury Wednesday.
Middlesex County Assistant Prosecutor Sheree Pitchford revealed the news before Superior Court Judge Michael Toto Tuesday at the beginning of a hearing at which Roper's attorney, David Glassman, was asking the judge to dismiss the charges against his client.
Roper is charged with vehicular homicide and four counts of assault by auto in the June 2014 crash.
But, Toto adjourned the brief hearing until Jan. 6, 2016, when Pitchford told him the grand jury's actions would be released Wednesday.
The news came as Pitchford argued against a motion by Roper's attorney to dismiss the charges brought against the truck driver after the accident.
Roper was driving a truck for Wal-Mart in June 2014 when he allegedly crashed into a limousine van ferrying Morgan, Jimmy McNair and other friends of Morgan down the New Jersey Turnpike in Cranbury. McNair was killed in the crash; fellow comedians Ardie Fuqua, Harris Stanton and Morgan's assistant Jeff Millea were injured, along with Morgan.
A Georgia native, Roper has pleaded not guilty.
Authorities said Roper failed to see slow-moving traffic ahead of his rig as he passed through Cranbury, slamming into the rear of Morgan's van and causing a chain reaction involving four other vehicles, including another tractor-trailer.
Wal-Mart has settled Morgan's lawsuit for an undisclosed sum.
After more than a year of recovery from his injuries, Morgan made his return to Saturday Night Live in October.
