NEW BRUNSWICK -- A Middlesex County grand jury has charged a New Brunswick man with the murder of another city man following an argument in a restaurant in July.
The indictment charges Edgar Martinez with murder, unlawful possession of a weapon--a knife--and possession of a weapon for an unlawful purpose.
Martinez is charged with fatally stabbing Jovanni Garcia-Elvira, 20, in an early-morning argument at the El Consteno restaurant on Suydam Street on July 4.
Middlesex County Assistant Prosecutor Scott LaMountain told Superior Court Judge Alberto Rivas at Martinez's first court appearance in July that investigators found the murder weapon and that Martinez confessed.
Authorities said police found Martinez walking down Joyce Kilmer Avenue shortly after Garcia-Elvira was killed.
LaMountain also told the judge that Martinez is in the country illegally.
His attorney, George Nassif, asked the prosecutor at the hearing to preserve any blood samples, because Martinez's intoxication could play a role in his defense.
Martinez is being held in the Middlesex County jail in lieu of $2 million bail.
