Prosecutors are seeking gag order in Timmy Wiltsey trial Watch video

NEW BRUNSWICK -- Superior Court Judge Dennis Nieves is expected to hear arguments Thursday morning on whether to order Michelle Lodzinski's lawyer, Gerald Krovatin, to stop talking to the news media during her murder trial.

The Middlesex County Prosecutor's Office filed a motion to "gag" Krovatin after he gave an interview to The Associated Press and, prosecutors claim, volunteered evidence the state intends to present during Lodzinski's trial for the 1991 murder of her 5-year-old son, Timothy Wiltsey.

The story ran several days before jury selection resumed in the case on Feb. 17.

The issue of Krovatin speaking to reporters has come up before during pre-trial hearings when members of news media from New York television stations have appeared. Prosecutors have accused Krovatin of calling them, an accusation he has vehemently denied.

According to MyCentralJersey.com, Krovatin has argued in court papers that the motion should be denied. His comments did not jeopardize a fair trial and a gag order would infringe on his right to free speech, he reportedly argued.

Lodzinski was charged in August 2014 with the death of her son, whom she reported missing the evening of May 25, 1991 from a carnival in Sayreville. She told police he disappeared when she went to a stand to buy soda.

Prosecutors said the case was reopened after new evidence linked Lodzinski, who was living in Florida, to her son's death.

Wiltsey's remains were found in a marshy area in Raritan Center in Edison 11 months after his disappearance. She has pleaded not guilty, and her lawyer said there's "no evidence" linking her to her son's death.

Jury selection is expected to take several weeks and the trial is expected to take three or four months.
